• There are no existing state-wide paid family leave laws applicable to all employees in effect at this time.

• Paid Family Medical Leave is available to eligible State of South Dakota employees, providing paid leave for certain qualifying FMLA events. Employees may qualify for up to 40 hours per week for 12 weeks per year.

• Eligible employees include those individuals who have worked for the state for a year or more, have worked 1,250 hours in the proceeding 12-month period, have 80 or fewer hours of sick leave, and have a qualifying PFMLA event.
